JASON Terms of Service and Privacy Policy

By using Rokubun’s Jason Service site (the "Site"), you agree to these Terms of Use. If you do not agree to these Terms of Use, you may not use Rokubun’s Jason Service site. Through the Site, you have access to a variety of resources, information, content, services, as well as outputs or results from those services, collectively referred to as "Information".

These Terms of Use ("Terms") are between you ("You", "you" or "Customer") and Rokubun. By signing up to Jason service (creating your Jason service account), placing an order, clicking to accept these Terms, or accessing or using the Jason service ("Service") or website ("Site") or the Information provided on or through the Site, You agree to all the terms and conditions of these Terms. If you are entering this Agreement on behalf of a company or an entity, then "You" or "Customer" means that company or entity and You represent and warrant to Rokubun that You have all necessary legal authority to bind that entity or company to these Terms. Rokubun may revise the Terms of Use at any time without notice to you. The most current Terms of Use are on 15th March 2021. The revised Terms of Use will be effective when posted in the Site or when indicated in the same publication.

In compliance with Law 34/2002, of July 11, on Information Society Services and Electronic Commerce (LSSI-CE), ROKUBUN SL informs that it is the owner of the website. In accordance with the requirement of article 10 of the aforementioned Law, ROKUBUN SL reports the following data

In order to access certain restricted portions of this Site or to sign up for the Service, You must be 18 years old and You are required to register on this Site by completing a Registration Form or Enrollment Form (collectively, the "Registration Form"). Rokubun may accept or reject any Registration Form in its sole discretion. You represent and warrant that the information provided when registering is accurate, complete and current as of the date submitted and that You will update such information from time to time as necessary. These Terms shall be incorporated into, and form an integral part of, each Registration Form.

As part of the registration process, You will provide your name and surname and select a user name based on your e-mail ("User Name"), and a password ("Password") to access the User Name. You will provide as well information about what do You use Jason for. Your User Name and Password are your credentials ("Credentials") to access the restricted portions of this Site. You may not have a User Name that is vulgar, attempts to impersonate another person, or violates the rights of others. Rokubun may also reject any User Name that Rokubun determines in its discretion is unacceptable for use on this Site.

You are solely responsible for all use of this Site under your User Name and Password and for maintaining the confidentiality of your User Names and Passwords and will (i) promptly notify Jason of any actual or suspected unauthorized use of this Site or Service, and (ii) ensure that you exit from your account at the end of each session. If you disclose or otherwise allow discovery of your User Name and/or Passwords to or by any person(s) or entity, you assume all risks and losses associated with such disclosure.

You agree not to engage in any of the following prohibited activities: (i) copying, modifying, creating derivatives, distributing, disclosing, selling or offering to sell any part of the Site or Service in any medium, including without limitation by any automated or non-automated scraping;(ii) attempting to interfere with, compromise the system integrity or security or decipher any transmissions to or from the servers running the Service; (iii) taking any action that imposes, or may impose at our sole discretion an unreasonable or disproportionately large load on our infrastructure; (iv) uploading invalid data, viruses, worms, or other software agents through the Site or Service; (v) collecting or harvesting any personally identifiable information, including account names, from the Site or Service; (vi) impersonating another person or otherwise misrepresenting your affiliation with a person or entity, conducting fraud, hiding or attempting to hide your identity; (vii) interfering with the proper working of the Site or Service; (viii) accessing any content on the Site or Service through any technology or means other than those provided or authorized by the Site or Service; or (ix) bypassing the measures we may use to prevent or restrict access to the Site Service, including without limitation features that prevent or restrict use or copying of any content or enforce limitations on use of the Site or Service or the content therein.

Rokubun has the right to modify, suspend or discontinue, temporarily or permanently, the Site or Service, any products or services provided by Rokubun through the Site or Service, or your right to access or use any portion of the Site or Service, in Rokubun’s sole discretion, at any time and without prior notice, for any reason, including without limitation: (1) attempts by you (or another party) to gain unauthorized access to the Site, Service or assist others in attempting to do so, (2) your (or another party’s) disabling of any security features on the Site or Service, (3) your violation of these Terms, (4) suspected or actual infringement of a third party’s intellectual property rights or (5) pursuant to requests by law enforcement or other government agencies. The obligations and liabilities you incurred prior to the termination date shall survive the termination of these Terms for all purposes. In the event of any such termination, the restrictions on your use of the material on the Site or Service shall survive such termination, and you agree to be bound by those terms. YOU ACKNOWLEDGE AND AGREE THAT Rokubun SHALL NOT BE LIABLE TO YOU OR TO ANY THIRD PARTY FOR ANY MODIFICATION, SUSPENSION OR DISCONTINUANCE OF ANY SITE OR ANY SERVICE OR INFORMATION PROVIDED ON THIS SITE OR ACCESSED BY YOU THROUGH THIS SITE OR SERVICE.

The Site and Information provided on or through the Site are the intellectual property and copyrighted works of Rokubun or a third party provider. All rights, title and interest not expressly granted with respect to the Site and Information provided on or through the Site are reserved. All Information is provided on an "As Is" and "As Available" basis, and Rokubun reserves the right to terminate the permissions granted to you and your use of the Information at any time.

You may choose to or we may invite you to submit comments or ideas about the Site, Service or the Jason service Content, including without limitation about how to improve the Site, Service, our products, services and the Jason service Content (collectively, "Idea"). By submitting any Idea, you agree that your disclosure is gratuitous, unsolicited and without restriction and will not place Rokubun under any fiduciary or other obligation, and that we are free to use the Idea without any additional compensation to you, and/or to disclose the Idea on a non-confidential basis or otherwise to anyone. You further acknowledge that, by acceptance of your submission, Rokubun does not waive any rights to use similar or related ideas previously known to Rokubun, or developed by its employees, or obtained from sources other than you.

License Grant. Subject to the terms and conditions of these Terms, you are hereby granted a non-exclusive, limited, non-transferable, freely revocable license to use the Site, Service and Jason service Content for your personal or internal business purpose use only and as permitted by the features of the Site or Service. Rokubun reserves all rights not expressly granted herein in the Site, Service and the Jason service Content (as defined below). Rokubun may terminate this license at any time for any reason or no reason.

The Site provides general information about Jason service and its products and services. Use of this Site is limited to legitimate purposes. Rokubun may, from time to time, introduce new features to the Site or Service, or modify or delete existing features, in its sole discretion. Rokubun shall notify you of any of these changes to features to the extent Rokubun is required by law to do so. By using any new or modified features to the Site or Service when they become available, you agree to be bound by these Terms concerning such new features.

Rokubun has no obligation to update any information or content on any Site. Accordingly, Rokubun, its subsidiaries, affiliated companies and joint partners assume no responsibility regarding the accuracy of the information or content provided on the Site. Any use of the information or content provided on this Site is done so at your own risk.

You agree that you will not use the Site or the Information to infringe Rokubun's Intellectual Property rights or the Intellectual Property rights of third parties. You may not remove, deface, or overprint any notice of copyright, trademark, logo, or other notice of ownership from any Information or copies thereof.

Some of Jason service’s products and services exist and rely on sites owned and operated by third-parties. Certain functional aspects of Jason service’s products and services may be out of our control. Accordingly, Rokubun cannot guarantee the continued reliability or functionality of products or services hosted on third-party sites. Rokubun will make commercially reasonable efforts to assist you in accessing and trouble-shooting affected products.

Billing Policies. Certain aspects of the Service may be provided for a fee or other charge. If you elect to use paid aspects of the Service, you agree to the pricing and payment terms listed on the Site, as Rokubun may update them from time to time. Rokubun may add new services for additional fees and charges, or amend fees and charges for existing services, at any time in its sole discretion. Any change to our pricing or payment terms shall become effective in the billing cycle following notice of such change to you as provided in these Terms. Rokubun may lock your account for non-payment at any time. In addition to the amount due, delinquent accounts and/or chargebacks will be charged with fees and/or charges that are incidental to the collection of delinquent accounts and/or chargebacks including, but not limited to, collection fees and/or convenience fees and/or other third parties’ charges. You hereby explicitly agree that all communication in relation to delinquent accounts will be made by electronic mail or by phone. Such communication may be made by Rokubun or by anyone on our behalf, including but not limited to a third party collection agent.

Payment Information; Taxes. All information that you provide in connection with a purchase or transaction or other monetary transaction interaction with the Service must be accurate, complete, and current. You agree to pay all charges incurred by users of your credit card, debit card, or other payment method used in connection with a purchase or transaction or other monetary transaction interaction with the Service at the prices in effect when such charges are incurred. You will pay any applicable taxes, if any, relating to any such purchases, transactions or other monetary transaction interactions.

Free Trial. Rokubun is under no obligation to offer a free trial of any products or services. However, Rokubun may, at its sole discretion, offer free trials. Rokubun makes no warranties about the delivery time of such a free trial, and all free trials are subject to discontinuation by Rokubun at any time for any reason, without notice. Upon the cancellation of a free subscription of the Service, any discount obtained via a coupon code will be null and void and any future subscription for the Service will be charged pursuant to Jason service’s normal pricing structure at that time.

Withdrawal right: You have the right to withdraw you contracted paid subscription within the first 14 days after the contract.

These Terms include the terms and conditions of Jason service’s Privacy Policy. Accordingly, by using the Site or the Service, you affirmatively acknowledge that you have read, understood and agree to be legally bound by the terms and conditions of Jason service’s Privacy Policy.

Rokubun informs you that your information is automatically stored in our users database. The information supplied by you may be used by Rokubun for research and marketing purposes and for the provision of the Information. You can edit your personal information or exercise your rights of access, correct or cancel this information, according to applicable law, contacting us at the following address:

Rokubun shall be permitted to collect and use the "Uploaded Data" by the User to Jason service for its reasonable business purposes, unless the data is protected by a signed agreement (such as, but not limited to, a Non Disclosure Agreement) between the User and Rokubun. In the event that Rokubun wishes to disclose the "Uploaded Data", any part thereof or metadata constructed from the "Uploaded Data" to third parties, such data shall be anonymized and/or presented in the aggregate so that it will not identify the User. The foregoing shall not limit in any way Rokubun's confidentiality obligations pursuant to this Terms of Service.

Jason service makes no representation that materials on the Site or the Service or the Information are appropriate or available for use in any location, and accessing them from territories where their contents are illegal is prohibited. Those who choose to access the Site or Service from other locations do so on their own initiative and are responsible for compliance with local laws.

While Rokubun will make reasonable efforts to procure that the Information, in particular the online Jason service ("Service"), are always available, interruptions in the Service and degradation of its performance may occur from time to time and therefore the availability and quality of the data service is not guaranteed. Therefore, Rokubun accepts no responsibility for the availability or quality of the Service under any circumstances

You agree not to access or use the Site in any manner that could damage, disable, overburden, or impair any Jason Service accounts, computer systems or networks. You agree not to attempt to gain unauthorized access to any parts of the Site or any Service accounts, computer systems or networks. You agree not to interfere or attempt to interfere with the proper working of the Site or any of the Service accounts, computer systems or networks. You agree not to use any crawler, spider or scraper or other automated means to access the Site or any not authorized by these Terms of Use

You are not authorized to rent, lease or share your Service account online services account to any third party, and Rokubun reserves the right to cancel the access to the Service without any compensation or payment refunding if you do not comply with these obligations

There is no guarantee that any e-mail you send will be received by Rokubun. E-mail is not a secure form of communication and can be intercepted by third parties so e-mails sent to Rokubun when making use or accessing Information and Services are not confidential or may be subject to tampering. Any information sent by e-mail is done so at your own risk and you should carefully consider its sensitivity before transmitting it

By signing up to the Service, you agree to be included in Jason service newsletter. You may unsubscribe to this newsletter at any time

Subject to these Terms of Use you are authorized to personally use the Site and the Information, in particular the Services, for the purpose of GNSS products generation, GNSS Performance Analysis and Precise Positioning

You are authorized to include the Service results in any publication provided you also include an explicit and clear reference to Rokubun and to the PaaS online service

Except as provided elsewhere in these Terms of Use, your right of use of the Site and the Information, in particular the Services, shall not include:

1. any delivery or disclosure of any kind of software, either in whole or in part, in any form whatsoever, to you or to any third party;
2. making the Services available to any third party by any means for any purpose whatsoever;
3. creating a link to this Site or to the Information;
4. making use of any Information, in particular any Service results, with a commercial or reselling purpose;
5. any use of this Site or the Information, in particular the Service results, in competitive procurements or for the commercial benefit of any third party.

Whenever the Services require a paid subscription account you are not authorized to use those Services and related Information without a current, valid, fully paid subscription

As a condition of your use of the Site you agree that you will not use the Site or Materials for any purpose that is unlawful or prohibited by the Terms of Use. You will be responsible for any costs incurred by any other party (including attorneys fees) as a result of your misuse of the Site. Misuse use includes, but is not limited to,

• Using the Site to disseminate or convey inappropriate, defamatory, obscene, salacious, or unlawful information, images or materials; or to defame, harass, stalk, threaten or otherwise violate the legal rights of others.

• Using any information, images or other Materials available through the Site in any manner that infringes any copyright, trademark, patent, trade secret or other proprietary right of any party.
• Advertising, offering to sell or buy goods, or using the Site for business promotional purposes;
• Violating any code of conduct associated with the Site, or any applicable laws or regulations;

Taking any action that imposes an unreasonable or disproportionately large load on the Site infrastructure; or uploading files that contain viruses, Trojan horses, worms, or other similar software or programs that cause damage to computers or property of others

Rokubun does not monitor or review the content of other party’s websites which are linked to from this Site. Rokubun is not responsible for third party content provided on or through this Site or for any changes or updates to such third party sites, and you bear all risks associated with the access to, and use of, such websites and third party content, products or services

Except where expressly provided otherwise, the Site, and all Information provided on or through the Site, in particular the Services, are provided on an "as is" and "as available" basis. Rokubun expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose and non-infringement with respect to the Site and all Information provided on or through the Site. Rokubun makes no warranty that: (a) the Site or Information, in particular the Services, will meet your requirements; (b) the Site will be available on an uninterrupted, timely, secure, or error-free basis; (c) the results that may be obtained from the use of the Site or any Information provided on or through the site, in particular the Services, will be accurate or reliable; or (d) the quality of any Information, in particular the Services, purchased or obtained by you on or through the site will meet your expectations

Any Information, in particular the Services, accessed, downloaded or otherwise obtained on or through the use of the site is used at your own discretion and risk. Rokubun shall have no responsibility for any damage to your computer system or loss of data that results from the download or use of Information. The user understands and acknowledges that Information and Services, in particular Rokubun’s Jason online service, are not to be used for any life-critical or safety- critical related use or application

Rokubun reserves the right to make changes or updates to, and monitor the use of, the site and Information provided on or through the site at any time without notice

To the maximum extent permitted by the applicable law, in no event shall Rokubun be liable for any direct, indirect, incidental, special or consequential damages, or damages for loss of profits, revenue, data or data use, incurred by you or any third party, whether in an action in contract or tort, arising from your access to, or use of, the Site or any Information provided on or through the site, in particular the Services.

Rokubun may, in its sole discretion, at any time discontinue providing or limit access to the Site, any areas of the Site or Information provided on or through the Site. You agree that Rokubun may, in its sole discretion, at any time, terminate or limit your access to, or use of, the Site or any Information. Rokubun may terminate or limit your access to or use of the Site if Rokubun determines that you have infringed upon these Terms of Use. You agree that Rokubun shall not be liable to you or any third-party for any termination or limitation of your access to, or use of, the Site or any Information

The failure of Rokubun to exercise or enforce any rights or provisions in these terms of Use shall not constitute a waiver of such right or provision. If any part or provision of these Terms of Use is found to be unenforceable, such part or provision may be modified to make the Terms of Use as modified legal and enforceable, and shall not affect or impair the remaining provisions of this Terms of Use. To this end the provisions of these Terms of Use are hereby declared to be severable

The SSL CERTIFICATE provides authentication, privacy and security of the information between ROKUBUN SL and the user. ROKUBUN SL has a security certificate that is used by SSL CERTIFICATE to make secure connections. In this process, several parameters are established to make the connection safely and it is established using preset keys, encoding and decoding all the data sent until the connection is closed.

You agree to defend, indemnify, save and hold harmless Rokubun and its subsidiaries, affiliated companies, joint partners and licensees and their respective directors, members, shareholders, officers, employees and agents from and against all liabilities, claims, damages and expenses, including reasonable attorneys’ fees as incurred, arising out of your use of the Site and the Service, including any violation or alleged violation of these Terms.

These Terms of Use and all matters relating to your access to, and use of, the Site and the Information, in particular the Services, provided on or through or uploaded to the Site shall be governed by the Spanish Law. This licence is governed by the laws of Spain. Legal proceedings related to this license may only be brought in the courts of Spain

You and Rokubun agree to submit to the exclusive jurisdiction of, and venue in, the courts Barcelona in Spain in any dispute arising out of or relating to these Terms of Use and all matters relating to your access to, and use of, the Site and the Information.
